Judge Calvin Struyk gave his decision on the preliminary inquiry of Robert Purchase Thursday afternoon in Terrace Provincial Court.

A preliminary inquiry is held to determine whether there’s enough evidence to go to trial.

A publication ban prevents any of the evidence given at the preliminary inquiry from being printed.

On the morning of November 8, 2009, Arkadiusz Rejczak was stabbed on Angle St. in Kitimat, said police at that time.

Police reported that they were searching for a man seen at the scene and later arrested Purchase in Terrace.

The RCMP investigation, in conjunction with the major crimes unit in Prince George, revealed that Purchase had been in a fight with the victim.

Rejczak died of his wounds.

The next scheduled day in court is Sept. 6 to fix a date for trial.
